Terms and Conditions

1. Overview

These Terms and Conditions (“Terms”) form the agreement between you (“student”, “participant”) and Deeside Yoga Institute, operated by Gemma Maryan (“we”, “us”, “our”), in relation to enrolment in any online, in-person, or hybrid training programme (“Training”).

By enrolling in, accessing, or participating in any Training, you agree to these Terms.

2. Nature of Services and Scope of Practice

Deeside Yoga Institute provides professional yoga education and continuing professional development.

All Trainings are educational in nature. They do not constitute medical, psychological, physiotherapy, or clinical services. Participation does not establish a therapeutic or healthcare relationship.

All content, including anatomy, fascia science, nervous system education, philosophical systems, and energetic frameworks, is delivered within the scope of professional yoga education.

Students remain responsible for practising and teaching within their own level of training and competence. Nothing within a Training qualifies a participant to diagnose, treat, or provide healthcare services unless separately licensed or qualified to do so.

Interpretive systems such as fascia models, pain science, meridian theory, chakra systems, or classical philosophy are presented for educational purposes. They must not be represented as medical or clinical claims.

3. Booking and Payment

  • Payment is due in full at enrolment unless a written payment plan is agreed.
  • Deposits and instalments must be paid by stated deadlines.
  • Access to course materials may be suspended if payments are overdue.
  • All prices are listed in GBP.
  • Your place is confirmed once payment or a deposit is received.

4. Cooling-Off Period

  • You have 14 days from booking to cancel for a full refund, provided:
  • The Training has not started, and
  • You have not accessed digital materials or entered the learning platform.
  • Accessing digital content during this period may remove your right to a refund, except where required by law.

5. Cancellations and Refunds

After the 14-day cooling-off period:

  • Fees are non-refundable.
  • Non-attendance does not qualify for a refund.
  • Transfers may be offered at our discretion but are not guaranteed.
  • If a Training is cancelled by us, a refund or transfer will be offered.

6. Online Platform Access

Online and hybrid training are delivered through a secure learning platform: Teachable

Access is:

  • Personal and non-transferable
  • Not to be shared or redistributed
  • For educational use only
  • Course materials may not be copied, reproduced, recorded, distributed, adapted, or resold without written permission.
  • Where lifetime access is offered, this refers to the lifetime of the hosted course, not the lifetime of the participant.
  • We reserve the right to update or reorganise content where necessary.

7. Attendance, Completion and Certification

  • Certification is not automatic upon enrolment.
  • To receive a certificate, you must:
  • Attend required live training hours
  • Complete required modules within the platform
  • Submit any required assignments or assessments
  • Maintain professional conduct
  • Complete all payments
  • Attendance alone does not guarantee certification.
  • Failure to meet requirements may result in delayed or withheld certification.

8. Conduct

Participants agree to:

  • Maintain respectful communication
  • Respect confidentiality within training cohorts
  • Avoid harassment or discrimination
  • Maintain professional boundaries

We reserve the right to remove participants whose behaviour is unsafe or disruptive. No refund will be issued in such cases.

9. Health and Participation

Yoga involves physical participation.

You confirm that you are fit to participate and will practise within your own limits. You are responsible for creating a safe environment for online participation.

Participation is undertaken at your own risk.

10. Intellectual Property

All materials remain the intellectual property of Deeside Yoga Institute / Gemma Maryan.

They may not be shared, reproduced, distributed, or adapted without written permission.

11. Liability

To the fullest extent permitted by Scottish law, Deeside Yoga Institute and Gemma Maryan accept no liability for injury or loss arising from participation, except where liability cannot legally be excluded.

12. Governing Law

These Terms are governed by Scottish law. Disputes fall under the jurisdiction of the Scottish Courts.
